This Service is operated by Silentnight Group Limited registered in England and Wales with company number 7525259 ("Silentnight"). In these Terms "us", "we" or "our" means Silentnight and "you" or "your" means the individual using the Services.


Please read these terms and conditions carefully as they affect your rights and liabilities under the law in relation to wireless internet access service (the "Service"). The terms and conditions together with our Acceptable Use Policy and Privacy Policy (the "Terms") govern your use of the Services.

Your use of the Service indicates your acceptance of these Terms. If you do not agree to these Terms, you must not use the Service.

We reserve the right, at our discretion, to modify, add to or remove any of the Terms at any time where required to do so by any applicable law, regulation or competent authority. We may also modify any of the Terms where it is reasonable to do so.

Your continued use of the Service following the updating of the Terms indicates you accept those changes.

We reserve the right to suspend your access to the Service if we: (i) reasonably believe that your use of the Service is unreasonably excessive or (ii) reasonably believe that you are using the Service for criminal or illegal activities; or (iii) you are otherwise in breach of these Terms. Unauthorised use of the Service may give rise to a claim against you for damages and/or be a criminal offence.

When you use the Service, all your internet traffic and e-mails pass through our servers. Some of it may occasionally be captured and stored as part of our routine backup processes. However we do not and will not monitor, read or examine that traffic at any time in such a way as to see any personal data unless at any time we are required to do so by law.

For that reason, we cannot be responsible for the security of any content you transmit or receive using the Service.

We reserve the right to block any websites, web pages and content on such services we deem illegal, distasteful or generally unsuitable for the location in which this Service is provided. These Terms do not exclude or limit our liability (if any) to you for personal injury or death resulting from our negligence, or for any matter in respect of which it would be illegal for us to exclude or to attempt to exclude our liability. This applies if you are a consumer, as the terms of these Terms will not affect any of your statutory rights, which cannot legally be excluded.

Notwithstanding these exclusions we shall not be liable to you in any circumstances for (i) any financial loss; (ii) information or loss of data; (iii) liability for identity theft or misuse of your identity and information; (iv) security breach; (v) loss of goodwill; or (vi) other pecuniary loss, including loss or damage suffered as a result of any virus, denial of service, spamming or hacking (in each case whether direct or indirect), or any indirect, special or consequential losses.

Subject to the liability exclusions set out above, our maximum aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence) or otherwise, shall be limited to one thousand pounds sterling (£1,000) in aggregate.

The Service is provided on as "as is" basis and "as available" basis. We do not make any warranty that the Service will be uninterrupted, timely, secure, or error free, or that any software defects will be corrected or that the web portal or the server that makes it available is free of viruses or other harmful components. We do not give or assume any warranty, condition, undertaking or term, whether statutory, express or implied, as to condition, satisfactory quality, performance, durability, fitness for purpose or otherwise of this page and/or the Service and all such terms and warranties are hereby excluded to the fullest extent permitted by law.
